Please take the time to read this ReFleX Wireless privacy policy (the “Privacy Policy”). This Privacy Policy explains ReFleX Wireless's privacy practices for the ReFleX Wireless platform (the “Platform”) comprising the ReFleX Wireless website (the Website”), the application (the “Application”), and any and all services, member-to-member communication tools, emails, databases, data storage, and technical support. It explains what type of personal data is collected, how it is used, and with whom it may be shared. The privacy of your personal information is very important to us.
 
This Privacy Policy governs how we manage your personal information and protect your privacy. This Privacy Policy is incorporated into and subject to our terms of use (the “Terms of Use”). By using the Platform, you agree to be bound by the terms described in this Privacy Policy.
 
Scope of this Privacy Policy
This Privacy Policy applies only to your relationship with ReFleX Wireless. It does not apply to the interactions that you have with any other individual or other groups through the Platform.
 
If you decide to access third party applications on your device from the Platform, or get to the Platform from third party applications, any information those applications collect may be sent to third parties and this Privacy Policy does not apply. Those third party applications may have their own privacy policies that you should review.
 
What is "personal data"?
"Personal data" is any data that (1) is recorded in any form, (2) is about, or pertains to, a specific individual and (3) can be linked to that individual. For example, your name, contact information, and the data you input on your profile are "personal data."
Personal data does not include website data or aggregated data.
 
How we may Share your Data
ReFleX Wireless may disclose or share part of the information that you submit to the Platform. For example, we use your information to process and personalize your requests to and from the Platform. We also use the information for support, to develop new ReFleX Wireless features, and new ReFleX Wireless services. We also use the information to show you a history of your activity, to provide you with statistics about you or your use of our product or services, or to provide you with a better user experience of the Platform. We also collect and store statistics and other information about the online activities of users on an aggregate basis. This does not include personal data about you.
 
Under certain circumstances we may be forced to disclose information to the Government or third parties, or at times, third parties may unlawfully intercept or access transmissions or private communications. In the event that we need to investigate or resolve possible problems or inquiries regarding those matters, you expressly acknowledge, agree and authorize ReFleX Wireless to disclose any information about you to private entities, law enforcement or Government officials as we, in our sole discretion, believe necessary or appropriate.
 
Information sharing by You
Certain of our features and services allow you to interact and share your information with others. Please consider carefully before disclosing any personal information or data that might be accessible to others. More specifically, the Platform allows you to share your personal data with the doctor, health care professional, nutritionist, or dietician of your choice. Make sure to select carefully who you share your personal data with as it is done under your sole responsibility.
 
 
What kind of personal data is collected?
We will only collect personal data that has been obtained from you. You may provide us with information when you register with, or subscribe to, the Platform. We collect personal data at different locations and stages of your use of the Platform. We will not collect or monitor personal data about you without your consent unless we consider it is necessary:
1/ to comply with the law
2/ to comply with our Terms of Use
3/ to protect the rights and/or property of any other individual or entity, including members of the public
4/ to reduce or avoid a threat to anyone's health, safety or well-being,
5/ to provide services to you in a timely manner.
 
Also, any information you post in public areas (“Public Areas”) may be seen, collected and used by others and may result in unsolicited messages you may receive from time to time. We cannot control data you post in Public Areas. You post and publish them at your own risk. Any collection of personal data other than mentioned in this Privacy Policy and our Terms of Use requires your consent.
 
 
Use of Cookies
Cookies (“Cookies”) are pieces of information transferred from a website to your computer's hard disk for record-keeping purposes. Cookies do not personally identify users, although they do identify a user's browser. Most browsers are set to accept Cookies although you can reset your browser to refuse them.
 
Cookies and IP addresses can enhance your user experience of the Platform by allowing us to recognize you and anticipate your requirements. For example, Cookies allow you to store your password without the need to continually re-enter it. They allow us to tailor a website or a marketing message to provide you with information which is relevant to your particular interests. We may give you the option of subscribing to and receiving enhanced services. Refusing to accept Cookies may prevent you from fully utilizing some of these services.
 
We use Cookies to store visitors' preferences and to record session information, for purposes of ensuring that visitors are not repeatedly offered the same advertisements and to potentially customize messages, newsletters, advertising, and content based on browser type and user profile information. We do not link the information we store in Cookies to any personally identifiable information you submit while on our Website. Personal Data Access
You can access your personal data on the Platform and manage changes to or deletion of your personal profile at any time. You may also request a copy of your file from ReFleX Wireless or change the information we have about you or have it deleted entirely; if so, please contact us by postal mail or email at the addresses listed on the Platform and in the Contacting ReFleX Wireless section below. We will provide you with a copy of your file and do everything we reasonably can to alter or delete your information, unless we are required to maintain certain information for legal purposes. Please allow thirty (30) days for your request to be processed.
 
Access to the Platform by Children
Children under age 18 should always ask their parent(s) or guardian(s) for permission before using ReFleX Wireless and uploading their personal data to the Platform. We encourage all parents and guardians to make themselves aware of what personal data their children are posting or uploading to the Platform and to discuss privacy and safety issues with them. Any information posted by children in Public Areas may be seen, collected, and used by third parties at any time and may result in unsolicited messages or other unwanted attention! We cannot control this and cannot be held responsible for the actions undertaken by users of the Platform.
 
We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act), as we do not collect any information from anyone under 13 years of age. Our Platform is directed to people who are at least 13 years old or older.
 
 
Changes to this Privacy Policy
We reserve the right to make any changes to this Privacy Policy and to the Platform at any time and to add, remove, or change any of the features of the Platform that we deem necessary. Your acceptance of the Terms of Use entails your acceptance of those changes to the Platform and therefore to any corollary and necessary changes to this Privacy Policy. At any time we make any change to this Privacy Policy, changes will be posted to the Platform.
